§ 1. General provisions

  1. The online shop available at karstyl.pl (the Shop) is operated by Grzegorz Karcz, an entrepreneur conducting business under the name FPHU “Karstyl” Grzegorz Karcz, Spytkowice 572, 34-745 Spytkowice, Poland, NIP (tax ID) 7351259862, REGON 490721381, entered in the Polish Central Register and Information on Economic Activity (CEIDG) (the Seller).
  2. The Seller can be contacted by telephone at +48 601 836 919 or +48 512 681 644, by email at karstyl@interia.pl, and by post at Spytkowice 572, 34-745 Spytkowice, Poland.
  3. The terms used in these Terms mean:
    1. Customer — a natural person, a legal person or an organisational unit without legal personality to which the law grants legal capacity, using the Shop;
    2. Consumer — a natural person concluding a contract not directly related to their business or professional activity;
    3. Product — a movable item offered in the Shop;
    4. Contract — a contract for the sale of a Product concluded between the Customer and the Seller through the Shop.
  4. The provisions of §§ 6 and 7 concerning the Consumer also apply to a natural person concluding a Contract directly related to their business activity where the content of the Contract shows that it is not of a professional nature for that person, as follows in particular from the subject of their business activity published in the CEIDG register.

§ 2. Electronically supplied services

  1. The Seller provides the following electronic services in the Shop free of charge:
    1. browsing the offer and the cart — the agreement is concluded when the Shop page is opened and terminates when it is left;
    2. the order form, the contact form and the lead-time enquiry form — the agreement is concluded when filling in the form begins and terminates when the form is sent or filling it in is abandoned;
    3. chat — the agreement is concluded when the conversation begins and terminates when it ends;
    4. newsletter — the agreement is concluded for an indefinite period upon subscription. The Customer may terminate it at any time using the link in the message or by sending a request to karstyl@interia.pl;
    5. Customer account — lets the Customer view orders and withdraw from the Contract as described in § 6. The agreement is concluded for an indefinite period upon creation of the account, which happens at the first sign-in with a code sent to the Customer's email address. The Customer may terminate it at any time by sending a request to delete the account to karstyl@interia.pl.
  2. Using the Shop requires a device with internet access, an up-to-date web browser with JavaScript and cookies enabled and — when placing an order, sending a form, subscribing to the newsletter or creating an account — an active email address.
  3. Using electronically supplied services involves risks typical of the internet, in particular malware and attempts to obtain data fraudulently (phishing). The Seller recommends using up-to-date software and caution towards messages impersonating the Shop. The Seller never asks for payment card details by email.
  4. The Customer may not submit unlawful content through the Shop.
  5. The Customer may submit complaints about electronically supplied services to karstyl@interia.pl. The Seller handles a complaint within 14 days of its receipt.

§ 3. Conclusion of the Contract

  1. To place an order, the Customer selects the Product and its variant, adds it to the cart, provides the data necessary to fulfil the order in the order form, selects the delivery and payment methods and confirms the order with the button whose label („Zapłać teraz” or „Zamawiam i płacę”) indicates an obligation to pay.
  2. The Contract is concluded when the Customer receives the email confirming acceptance of the order. That message lists the ordered Products, their prices and the delivery cost.

§ 4. Prices and payments

  1. Product prices are gross prices including VAT, stated in Polish złoty. The delivery cost is shown to the Customer in the cart and in the order form before the order is placed.
  2. The available payment methods are shown in the order form. Online payments (in particular by payment card, BLIK, through digital wallets and Klarna) are made when the order is placed; payments through Klarna are additionally subject to Klarna’s terms. With cash on delivery, payment is made when the parcel is received.
  3. For personal collection, the parties may agree on another form of payment.

§ 5. Order fulfilment and delivery

  1. The Seller delivers only within the Republic of Poland.
  2. The Seller prepares the order for dispatch within 14 days of the conclusion of the Contract or, for online payments, of the payment being credited, unless the Product description states a different time or the parties agreed a different time before the order was placed.
  3. Products are delivered by a courier company (in particular DPD) within up to 3 business days of dispatch.
  4. The Customer may collect the Product in person at the Seller’s premises after arranging a collection time in advance.
  5. The Seller recommends that, if a parcel is damaged, the Customer draws up a damage report with the carrier. Not drawing up a report does not limit the Customer’s rights referred to in § 7.

§ 6. Right of withdrawal

  1. The Consumer may withdraw from the Contract within 14 days without giving any reason. The period runs from the day on which the Consumer, or a third party other than the carrier indicated by the Consumer, takes possession of the Product or, where the Product is delivered in parts (in several parcels), takes possession of the last part. If the period ends on a Saturday or a public holiday, it expires on the next day that is neither a Saturday nor a public holiday.
  2. The Consumer may also withdraw from the Contract before taking possession of the Product.
  3. To meet the deadline it is sufficient to send the statement of withdrawal to the Seller before the period expires, in particular to karstyl@interia.pl. The Consumer may use the model withdrawal form attached to these Terms, but this is not obligatory.
  4. The Consumer may also withdraw from the Contract using the withdrawal function available in the Shop. The “Withdraw from contract” link in the page footer leads to the “Orders” section of the customer account. After signing in with a code sent to the email address given in the order, the Consumer selects the order and the Products concerned and confirms the statement. Before the Product is dispatched, withdrawal takes the form of cancelling the order; after delivery, of a return request.
  5. The Seller promptly sends the Consumer an email confirming receipt of the statement of withdrawal.
  6. The Seller reimburses the Consumer for all payments made, including the delivery cost up to the cheapest standard courier delivery offered in the Shop, without undue delay and in any event within 14 days of receiving the statement of withdrawal. Reimbursement is made using the same means of payment the Consumer used and, for cash on delivery, by bank transfer to the account indicated by the Consumer. The Seller may withhold reimbursement until it has received the Product back or the Consumer has supplied evidence of having sent it back, whichever is earlier.
  7. The Consumer must return the Product to Spytkowice 572, 34-745 Spytkowice, Poland, without undue delay and in any event within 14 days of withdrawing from the Contract.
  8. The Consumer bears the direct cost of returning the Product. The estimated cost of return does not exceed 120 zł; the actual amount depends on the Product and the chosen carrier.
  9. The Consumer is liable for any diminished value of the Product resulting from handling beyond what is necessary to establish its nature, characteristics and functioning.

§ 7. Complaints

  1. The Seller is liable to the Consumer for any lack of conformity of the Product with the Contract that exists at the time of delivery and becomes apparent within 2 years of that time, under the Polish Consumer Rights Act of 30 May 2014.
  2. Complaints may be submitted by email to karstyl@interia.pl, by telephone or by post to the Seller’s address. The Seller asks for the order number, a description of the lack of conformity and, where possible, photographs; this is not a condition for handling the complaint.
  3. The Seller responds to a complaint within 14 days of its receipt. If no response is given within that period, the complaint is deemed accepted.
  4. If the Product does not conform with the Contract, the Consumer may demand its repair or replacement and, in the cases set out in Article 43e of the Consumer Rights Act, declare a price reduction or withdrawal from the Contract. The Seller bears the costs of repair, replacement and transport of the Product.

§ 8. Out-of-court complaint and redress procedures

  1. The Consumer may use out-of-court procedures for handling complaints and pursuing claims, in particular seek free assistance from a municipal or district consumer ombudsman (rzecznik konsumentów), apply for mediation to the Voivodeship Inspector of Trade Inspection in Kraków, or refer the matter to the permanent consumer arbitration court at the Voivodeship Inspectorate of Trade Inspection in Kraków.
  2. Information on out-of-court dispute resolution is available on the website of the Polish Office of Competition and Consumer Protection (www.uokik.gov.pl).
  3. Participation in out-of-court proceedings is voluntary for both parties. The Seller states whether it agrees or declines to take part in such proceedings in its response to the complaint.

§ 9. Final provisions

  1. Contracts are concluded in Polish.
  2. The rules for processing personal data and using cookies are set out in the Privacy Policy available in the Shop.
  3. The Seller may amend these Terms for important reasons, in particular changes in the law or in payment or delivery methods. Orders placed before the amendments take effect are governed by the Terms in force on the day the order was placed.
